CASSAZIONE: IL CONDEBITORE SOLIDALE NON PUò CONTESTARE L?"OPERATIVITà DEL RADDOPPIO DEI TERMINI IN SEDE DI IMPUGNAZIONE DELLA CARTELLA


Con Sentenza n. 21870 del 20 agosto 2024 la Corte di Cassazione, Sezione V Civile, esprimendosi in tema di accertamento tributario ha sancito che il raddoppio dei termini per la notificazione degli avvisi di accertamento previsto dall'art. 43, comma 3, del d.P.R. n. 600 del 1973, vigente ratione temporis, in presenza di seri indizi di reato che facciano insorgere l'obbligo di presentazione di denuncia penale, opera in relazione all’accertamento e al suo titolo di responsabilità principale, senza estendersi automaticamente al coobbligato solidale destinatario di un autonomo atto di iscrizione a ruolo. Fissato il suddetto principio di diritto relativamente al procedimento amministrativo, spiega la Cassazione, la motivazione espressa dal giudice nella sentenza impugnata dev’essere corretta nel senso che la contribuente non può, in sede di impugnazione delle cartelle di pagamento, utilmente contestare l’operatività o meno del raddoppio del raddoppio del termine ex art. 43 del d.P.R. n. 600 del 1973 in relazione agli avvisi di accertamento sottostanti. Viene così fissato anche il seguente, ulteriore principio di diritto relativo al processo, derivandone l’inammissibilità della censura: In tema di processo tributario, il condebitore solidale non può contestare in sede di impugnazione della cartella di pagamento l’operatività o meno del raddoppio dei termini di cui all'art. 43, comma 3, del d.P.R. n. 600 del 1973, vigente ratione temporis, in relazione alla notificazione dell’avviso di accertamento sottostante notificato al debitore principale, trattandosi di processo radicato in forza di un titolo diverso e successivo al consolidarsi dell’accertamento nei confronti del debitore principale.
