DALLE ENTRATE CHIARIMENTI SU VISTO DI CONFORMITà E DELEGHE DI PAGAMENTO


In data 24 aprile 2017 è stato pubblicato sulla Gazzetta Ufficiale il Decreto Legge n. 50/2017 (la cosiddetta "Manovrina") contenente una serie di nuove disposizioni fiscali particolarmente importanti. Tra le novità più rilevanti, in materia di compensazioni dei crediti, si è abbassata la soglia da 15.000 a 5.000 euro per l'obbligo dell'apposizione del visto di conformità ed è stato introdotto l'obbligo di presentazione dell'F24 tramite Entratel o Fisconline per i titolari partita di IVA che intendono compensare crediti. Il Decreto Legge non riporta nessuna indicazione sulla data di efficacia delle nuove disposizione ed è pertanto intervenuta l'Agenzia Entrate, che con la Risoluzione n. 57/E del 4 maggio 2017, ha chiarito che le nuove norme trovano applicazione per tutte quei comportamenti tenuti dopo la loro entrata in vigore e pertanto, alle Dichiarazioni presentate dopo il 24 aprile 2017. Ne consegue che, per le Dichiarazioni presentate entro il 23 aprile 2017 prive del visto di conformità restano applicabili i precedenti vincoli. Non potranno quindi essere scartate deleghe di pagamento che, anche se presentate dopo il 24 aprile, utilizzano in compensazione crediti derivanti da Dichiarazioni già trasmesse per importi inferiori a 15.000 euro.   L'Agenzia ha anche comunicato che, in considerazione dei tempi tecnici necessari per l'adeguamento delle procedure informatiche, il controllo in merito all'utilizzo obbligatorio dei servizi telematici dell'Agenzia Entrate in presenza di F24 presentati da titolari di partita IVA che intendono effettuare la compensazione di crediti inizierà? solo a partire dal 1° giugno 2017.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
