DETRAZIONI FISCALI PER RISTRUTTURAZIONE: SE IL BONIFICO è ERRATO SERVE LA DICHIARAZIONE SOSTITUTIVA RILASCIATA DALL'IMPRESA


L'Agenzia delle Entrate, in una recente risposta pubblicata sulla rivista telematica FiscoOggi, ha ricordato che per avvalersi dell'agevolazione fiscale sugli interventi di recupero del patrimonio edilizio, disciplinata dall'articolo 16-bis del TUIR, è necessario che le spese siano pagate tramite l’apposito bonifico dedicato, che deve riportare tutti i dati necessari alle banche (o a Poste Spa) per operare una ritenuta d’acconto nei confronti del destinatario del pagamento. Ma cosa accade se, per errore, il bonifico effettuato risultasse errato e non fosse possibile ripetere il pagamento?In questo caso, chiariscono le Entrate, il contribuente deve farsi rilasciare una dichiarazione sostitutiva di atto di notorietà dall’impresa, con la quale quest’ultima attesta che i corrispettivi accreditati a suo favore sono stati correttamente contabilizzati ai fini della loro imputazione nella determinazione del reddito d’impresa. Sarà poi il contribuente che intende avvalersi della detrazione che dovrà esibire tale documentazione in sede di predisposizione della dichiarazione dei redditi, al Caf o al professionista abilitato o, su richiesta, agli uffici dell’Amministrazione finanziaria.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
