DIRITTO ANNUALE 2017 - VERSAMENTO ENTRO IL 30 GIUGNO


1) Le misure del diritto annuale per l'anno 2017 sono state fissare con nota del Ministero dello Sviluppo Economico 15 novembre 2016 n. 359584, con la quale sono state confermate le riduzioni percentuali dell'importo del diritto camerale, previsto dal comma 1 dell'articolo 28 del D.L. n. 90/2014, convertito dalla legge n. 114/2014, che per l'anno 2017, è pari al 50% rispetto a quanto dovuto per il 2014. 2) L'importo del diritto annuale dovuto per il 2017 dovrà, inoltre, essere determinato tenendo presente quanto disposto dal decreto del Ministero dello Sviluppo Economico firmato del 22 maggio 2017 (in corso di pubblicazione sulla Gazzetta Ufficiale), con il quale viene data attuazione a quanto previsto dal comma 10, dell'articolo 18, della legge n. 580 del 1993, come, da ultimo, sostituito dal D.Lgs. 25 novembre 2016, n. 219. I progetti da finanziare sono indicati nelle deliberazioni dei consigli camerali elencate nell'Allegato A, che costituisce parte integrante del citato decreto. In sostanza, con tale decreto, il Ministero dello Sviluppo Economico ha autorizzato, per gli anni 2017, 2018 e 2019, l'incremento del 20% degli importi dovuti a titolo di diritto annuale a 79 Camere di Commercio, che con apposite delibere consiliari hanno disposto il finanziamento di appositi programmi e progetti, condivisi con le Regioni ed aventi per scopo la promozione dello sviluppo economico e l'organizzazione di servizi alle imprese. Nelle more della registrazione del decreto ministeriale da parte della Corte dei Conti e della successiva pubblicazione sulla Gazzetta Ufficiale: a) le imprese interessate che intendono già effettuare il pagamento entro il 30 giugno 2017, possono pagare in un'unica soluzione applicando la percentuale di aumento del 20% sugli importi del diritto dovuto per il 2017; b) le imprese che, invece, hanno già provveduto, per l'anno 2017, al versamento del diritto annuale, senza la maggiorazione del 20%, sono tenute ad effettuare il conguaglio rispetto all'importo versato entro il termine previsto per il pagamento del secondo acconto delle imposte sui redditi, ovvero entro il 30 novembre 2017. 3) Ricordiamo, infine, che l'art.7-quater, comma 19, del D.L. 22 ottobre 2016, n. 193, convertito con modificazioni nella legge 1° dicembre 2016, n. 225, ha modificato a decorrere dal 1° gennaio 2017, i termini dei versamenti di cui all'art. 17, del D.P.R. del 7 dicembre 2001, n. 435, posticipandoli al 30 giugno 2017. Tale modifica trova applicazione anche al diritto annuale che deve quindi essere versato in un'unica soluzione entro il termine previsto per il pagamento del primo acconto delle imposte sui redditi, e cioè: entro il 30 giugno 2017, fatti salvo i soggetti con diverso termine per il pagamento del primo acconto delle imposte sui redditi previsto in caso di proroga di approvazione del bilancio o con esercizio sociale non coincidente con l'anno solare; nei 30 giorni successivi con la maggiorazione dello 0,40% a titolo di interesse corrispettivo (termine posticipato al 31 luglio 2017, essendo il 30 luglio 2017 giorno festivo).
