La riapertura dei termini per rideterminare il valore di partecipazioni e terreni


La legge di bilancio 2024 (art. 1, commi 52 e 53) ha riaperto i termini per la rideterminazione del costo o del valore di acquisto delle partecipazioni e dei terreni (edificabili e con destinazione agricola), posseduti al 1° gennaio 2024, dietro il versamento di un’imposta sostitutiva nella misura del 16% da effettuarsi entro il prossimo 30 giugno 2024 in unica soluzione ovvero ratealmente, in tre quote annuali di pari importo Si tratta di fatto di una “riapertura” dei termini dell’istituto della rivalutazione, introdotto dagli articoli 5, commi 1 e 1-bis, e 7 della legge n. 448/2001, che consente, ai soggetti non imprenditori, di poter assumere, ai fini del computo di plusvalenze e minusvalenze, il valore “rideterminato” sulla base di una perizia, in luogo del costo o del valore di acquisto, mediante il versamento di un’imposta sostitutiva delle imposte sui redditi, parametrata al “valore di perizia”, ovvero a quello risultante da un’apposita perizia di stima giurata, redatta da professionisti abilitati. La nuova norma non cambia le peculiarità della disciplina: i profili oggettivo e soggettivo rimangono immutati e a cambiare, ai fini applicativi, sono soltanto i parametri temporali. Il pagamento dell’imposta dovrà essere effettuato con il modello F24, utilizzando i codici tributo già istituiti con la risoluzione n. 23/2023, con riferimento alla rivalutazione 2023 e precisamente: “8055” – Imposta sostitutiva delle imposte sui redditi per la rideterminazione dei valori di acquisto di partecipazioni non negoziate nei mercati regolamentati “8056” – Imposta sostitutiva delle imposte sui redditi per la rideterminazione dei valori di acquisto dei terreni edificabili e con destinazione agricola “8057” – Imposta sostitutiva delle imposte sui redditi per la rideterminazione dei valori di acquisto di titoli, di quote o di diritti negoziati nei mercati regolamentati o nei sistemi multilaterali di negoziazione.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
