Il mantenimento dei requisiti 4.0


Nella circolare 9/E 2021, l’Agenzia Entrate richiamando la risposta a istanza di interpello n. 394 dell’8 giugno 2021, specificava, anche sulla base del parere tecnico reso dal Mi.S.E. che: “il rispetto delle 5+2/3 caratteristiche tecnologiche e del requisito dell’interconnessione, dovranno essere mantenute in essere per tutto il periodo di godimento dei benefici 4.0. Al riguardo, si precisa che, ai fini dei successivi controlli, dovrà essere cura dell’impresa beneficiaria documentare, attraverso un’adeguata e sistematica reportistica, il mantenimento, per tutto il periodo di fruizione dei benefici, delle caratteristiche e dei requisitirichiesti”. In occasione dei controlli, anche dopo il termine di fruizione del beneficio quindi, l’Agenzia Entrate potrebbe richiedere una dimostrazione, “attraverso un’adeguata e sistematica reportistica”, che la macchina, l’impianto o il software abbiano mantenuto ininterrottamente i requisiti 4.0 per tutta la durata del periodo di godimento del beneficio. Come chiarito nella Circolare dell’Agenzia delle Entrate n. 4/E/2017, affinché un bene possa essere definito “interconnesso” , è necessario e sufficiente che: scambi informazioni con sistemi interni (es.: sistema gestionale, sistemi di pianificazione, sistemi di progettazione e sviluppo del prodotto, monitoraggio, anche in remoto, e controllo, altre macchine dello stabilimento, ecc.) e/o esterni (es.: clienti, fornitori, partner nella progettazione e sviluppo collaborativo, altri siti di produzione, supply chain, ecc.) per mezzo di un collegamento basato su specifiche documentate, disponibili pubblicamente e internazionalmente riconosciute (esempi: TCP-IP, HTTP, MQTT, ecc.); sia identificato univocamente, al fine di riconoscere l’origine delle informazioni, mediante l’utilizzo di standard di indirizzamento internazionalmente riconosciuti (es.: indirizzo IP). La prova del mantenimento dei requisiti potrà quindi avvenire documentando gli avvenuti scambi di informazioni (con tabulati e report identificabili per data) o, nei casi opportuni, da un vero e proprio audit tecnico svolto da un certificatore esterno. Si ritiene infine che, a prescindere dal tempo utilizzato per compensare il credito d’imposta o per terminare l’ammortamento del bene, l’intero periodo di godimento del beneficio sia da intendersi di 5 o 3 anni, a seconda che si tratti di iperammortamento o credito d’imposta.

  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
