RITARDO DEL VOLO PER CARENZA DI ADDETTI AL CARICO BAGAGLI: SENTENZA CORTE DI GIUSTIZIA UE SULL'OBBLIGO DI COMPENSAZIONE DEI PASSEGGERI


La Corte di Giustizia dell'Unione Europea, nella causa C-405/23 ha chiarito che l’articolo 5, paragrafo 3, del regolamento (CE) n. 261/2004 del Parlamento europeo e del Consiglio dell’11 febbraio 2004, che istituisce regole comuni in materia di compensazione ed assistenza ai passeggeri in caso di negato imbarco, di cancellazione del volo o di ritardo prolungato, e che abroga il regolamento (CEE) n. 295/91, deve essere interpretato nel senso che "il fatto che il personale del gestore aeroportuale addetto alle operazioni di carico dei bagagli negli aerei sia in numero insufficiente può configurare una «circostanza eccezionale», ai sensi di tale disposizione. Tuttavia, per poter essere esonerato dal proprio obbligo di compensazione pecuniaria dei passeggeri previsto all’articolo 7 di detto regolamento, il vettore aereo il cui volo abbia subito un ritardo prolungato a causa di una siffatta circostanza eccezionale è tenuto a dimostrare che tale circostanza non si sarebbe comunque potuta evitare anche se fossero state adottate tutte le misure del caso e che ha attuato misure adeguate alla situazione in grado di ovviare alle conseguenze di questa".   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
