CONTABILITà COMPLESSIVAMENTE 'INATTENDIBILE': POSSIBILE L'ACCERTAMENTO ANALITICO-INDUTTIVO


L’accertamento della complessiva inattendibilità delle scritture contabili preclude, di regola, la loro utilizzazione ai fini della determinazione del reddito, escludendo con ciò la possibilità di un accertamento di tipo analitico e lasciando spazio soltanto ad un accertamento induttivo "puro". Con due diverse sentenze datate 13 giugno 2024 (n. 16498 e n. 16528) la Corte di Cassazione, Sezione V Civile, accogliendo il ricordo dell'Agenzia Entrate ha chiarito che la contabilità di una società che risulti complessivamente o intrinsecamente inattendibile, anche se formalmente corretta, costituisce presupposto per procedere col metodo analitico-induttivo, da valutarsi sulla base di presunzioni ex art. 39, comma 1, lett. d), d.P.R. n. 600, del 1973, cioè gravi, precise e concordanti, richiedendo l’accertamento induttivo “puro”, che consente di avvalersi di presunzioni cc.dd. “supersemplici” prive dei requisiti di gravità, precisione e concordanza, la ricorrenza di una delle tassative condizioni previste dall’art. 39 comma 2 cit.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
