CESSIONE DI BENI MOBILI: FA FEDE LA CONSEGNA O SPEDIZIONE


La Suprema corte conferma che non influisce sull?"imputazione per competenza dei ricavi il momento in cui il venditore avvisa l?"acquirente della loro disponibilità. Ai fini dell?"attribuzione dei ricavi per competenza, la consegna va individuata nel momento in cui i beni escono dalla materiale disponibilità del venditore e vengono trasportati e montati presso la sede dell'acquirente in ragione di prestazioni a carico del venditore e non quello in cui la parte venditrice avvisa il cliente della messa a disposizione del bene presso un magazzino della stessa venditrice. Così si è espressa la Cassazione con l?"ordinanza n. 25757 del 26 settembre 2024. L'articolo comma 2 lettera a) Tuir (ove attribuisce rilievo, per determinare l'esercizio al quale vanno imputati i ricavi derivanti dalla vendita di beni mobili, al momento della consegna o della spedizione) intende infatti quale consegna il trasferimento della disponibilità materiale dei beni, anche nell'ipotesi in cui questa trasmissione sia successiva rispetto al trasferimento della proprietà dei beni eventualmente intervenuta in ragione del principio del consenso traslativo.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
