EQUO COMPENSO E CODICE APPALTI: NOVITà NEL DECRETO CORRETTIVO APPROVATO


Il Consiglio dei Ministri, nella seduta n. 101 del 21 ottobre, ha approvato, in esame preliminare, un decreto legislativo che introduce disposizioni integrative e correttive al Codice dei contratti pubblici (Dl n. 36/2023), con lo scopo di razionalizzarne e semplificarne la disciplina.Tra le principali novità introdotte, da segnalare le norme relative all'equo compenso.Il correttivo chiarisce i termini di applicabilità della legge sull?"equo compenso (legge 21 aprile 2023, n. 49) al settore dei contratti pubblici,  introducento specifici criteri per l'affidamento dei contratti relativi ai servizi di ingegneria e architettura e degli altri servizi di natura tecnica e intellettuale di importo pari o superiore a 140.000 euro, stabilendo che i corrispettivi, determinati secondo quanto stabilito dal “Decreto parametri”, siano utilizzati dalle stazioni appaltanti e dagli enti concedenti ai fini dell'individuazione dell'importo da porre a base di gara, comprensivo dei compensi, nonché degli oneri e delle spese accessori, fissi e variabili. Inoltre, le stazioni appaltanti procederanno all'aggiudicazione dei predetti contratti sulla base del criterio dell'offerta economicamente più vantaggiosa, individuata sulla base del miglior rapporto qualità/prezzo nel rispetto dei seguenti criteri: in relazione al 65% dell'importo da porre a base di gara, l'elemento relativo al prezzo assume la forma di un prezzo fisso (tale specificazione consente di individuare la componente non ribassabile dell'importo complessivo, in coerenza con il principio dell'equo compenso), per il restante 35% dell'importo da porre a base di gara, le tariffe possono essere oggetto di offerte al ribasso in sede di gara. Resta fermo l'obbligo per la stazione appaltante di stabilire un tetto massimo per il punteggio economico, entro il limite del 30%, in modo da valorizzare la componente relativa all'offerta tecnica e dunque, l'elemento qualitativo della prestazione oggetto dell'affidamento. Il testo prevede inoltre che, all'affidamento dei contratti di servizi di ingegneria e architettura, si applichino le disposizioni sulla verifica delle offerte anomale, con l'effetto di consentire l'esclusione automatica dalla procedura competitiva delle proposte non coerenti con i principi dell'equo compenso. Infine, si prevede che per i contratti dei servizi di ingegneria e di architettura di importo inferiore a 140.000 euro, oggetto di affidamento diretto, i corrispettivi determinati secondo le modalità previste nel relativo allegato al Codice possano essere ridotti in percentuale non superiore al 20%.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
