SPLIT PAYMENT E MANCATO PAGAMENTO DEL CORRISPETTIVO: NOTA DI VARIAZIONE IVA ANCHE OLTRE IL TERMINE ANNUALE


Per le operazioni in regime di split payment è possibile l'emissione della nota di variazione in diminuzione oltre un anno dalla fattura originaria, a condizione che il corrispettivo non sia stato pagato e che il cessionario/committente non abbia optato per l?"esigibilità dell?"imposta anticipata. Diversamente, infatti, tornerebbero applicabili i limiti temporali disposti dal comma 3 dell'articolo 26 del decreto IVA. A fornire il chiarimento l'Agenzia delle Entrate, nella Risposta n. 210 del 25 ottobre. Una società che ha emesso una fattura in regime di "split payment" e che, dopo un anno, necessita di emettere una nota di variazione in diminuzione per mancato pagamento della stessa, potrà quindni eseguire la rettifica oltre il termine annuale previsto dalla normativa (articolo 26, comma 3, del decreto Iva).Il limite temporale di un anno indicato dell'articolo 6, comma 3 del Dpr 633/1972, infatti, non rileva se il corrispettivo non è stato pagato e se il cessionario/committente non ha optato per l'esigibilità dell'Iva al momento di ricezione della fattura. Nell'ipotesi di scissione dei pagamenti, ricordano le Entrate, l'esigibilità dell'Iva è collegata al pagamento del corrispettivo che, nel caso in esame, non è avvenuto; dunque, la variazione operata dal cedente/prestatore assume una funzione sostanzialmente contabile, nel senso che è sufficiente effettuare nei registri Iva le opportune rettifiche, previa emissione della nota di variazione, nonostante sia decorso l'anno dall'emissione della fattura.Le suddette indicazioni sono valide a condizione che il cessionario/committente non si sia avvalso della facoltà di anticipare (nonostante il mancato versamento del corrispettivo) l'esigibilità dell'imposta al momento della ricezione della fattura o al momento della registrazione della medesima.
