AZIENDE DI TRASPORTO PUBBLICO: CHIARIMENTI SULLE COMUNICAZIONI DEI DATI PER LA PRECOMPILATA


L'Agenzia delle Entrate ha pubblicato quattro nuove FAQ, datate 5 novembre, in merito alle informazioni relative alle spese per l?"acquisto di abbonamenti delle persone fisiche, che le aziende di trasporto locale, regionale e interregionale devono trasmettere ai fini della dichiarazione precompilata. In una di queste l'Agenzia chiarisce che è sempre opportuno informare il titolare dell?"abbonamento che i dati sono trasmessi all?"Agenzia delle Entrate ai fini della dichiarazione precompilata, in modo che lo stesso possa esercitare il diritto di opposizione.Il contribuente, infatti, deve sempre essere messo in condizione di esercitare il diritto di opposizione all?"invio all?"Agenzia dei dati relativi alle spese da lui effettuate. In un altra FAQ si precisa che non è prevista la trasmissione dei dati di spesa nei casi di vendita di abbonamenti esclusivamente di tipo impersonale, quind se il biglietto non prevede alcun tipo di elemento identificativo del titolare e che possono essere utilizzati da chiunque. Come precisato nella Circolare n. 14/E del 2023, spiegano le Entrate, il titolo di viaggio deve contenere ogni informazione utile ad individuare il servizio reso (soggetto utilizzatore, periodo di validità, spesa sostenuta e data di sostenimento della spesa). Tali requisiti si ritengono soddisfatti anche nel caso in cui detta documentazione, pur non contenendo alcun riferimento esplicito al nominativo dell?"avente diritto, sia comunque a lui riconducibile in modo univoco, ad esempio perché contenente il numero identificativo dell?"abbonamento allo stesso intestato. Se invece, il titolo stesso non prevede alcuna individuazione del soggetto titolare dell?"abbonamento, i relativi dati non dovranno essere trasmessi, in quanto l?"azienda non ha disponibilità di un dato obbligatorio. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
