PATENTE A CREDITI PER GLI ARCHEOLOGI: NUOVI CHIARIMENTI DELL'INL


Con aggiornamento del 6 novembre l'Ispettorato Nazionale del Lavoro ha modificato una precedente risposta del 15 ottobre, relativa all'obbligo di patente a crediti per gli archeologi che operao all'interno dei cantieri. L'Ispettorato conferma innanzitutto che gli archeologi "operano" fisicamente nei cantieri temporanei o mobili di cui all?"art. 89, comma 1 lett. a), del D.Lgs. n. 81/2008 e, conseguentemente, devono essere dotati della patente. Ai fini della richiesta della patente occorre tuttavia tener conto di due fattori: che gli archeologi, in quanto liberi professionisti, non sono tenuti all?"iscrizione alla Camera di commercio; che la professione dell?"archeologo è una professione non ordinistica riconosciuta dalla L. n. 4/2013, normata dalla L. n. 110/2014 e regolamentata dal D.M. n. 244/2019, che non prevede esplicitamente l'istituzione di un albo ma stabilisce la creazione di elenchi professionali gestiti dal Ministero della Cultura (MiC), ai quali peraltro non è obbligatoria l'iscrizione per poter esercitare la professione. Considerato che, per la richiesta della patente da parte di una impresa o lavoratore autonomo italiano, il campo “iscrizione alla CCIAA” è obbligatorio, per gli archeologi lavoratori autonomi tale dichiarazione va intesa come indicativa dei necessari requisiti professionali, come il possesso della partita IVA e l?"iscrizione alla Gestione separata.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
