NON DOVUTA L'IMPOSTA DI REGISTRO PER LA RISOLUZIONE DEL CONTRATTO DI LOCAZIONE CON 'CEDOLARE SECCA'


Lo ribadisce l'Agenzia delle Entrate, in una risposta fornita sulla rivista telematica FiscoOggi.Per la risoluzione di un contratto di locazione per il quale è stata esercitata l?"opzione per il regime fiscale della “cedolare secca” non è richiesto il pagamento dell?"imposta di registro.Tra le imposte sostituite dalla cedolare secca rientrano, infatti, anche l?"imposta di registro dovuta sulle risoluzioni e sulle proroghe dei contratti, a condizione che alla data della risoluzione anticipata sia in corso l?"annualità per la quale è esercitata l?"opzione per la cedolare o venga esercitata tale opzione per il periodo di durata della proroga. Diverso il caso in cui vi sia la presenza di due o più locatori: in questa ipotesi, se anche un solo locatore non ha esercitato l?"opzione, l?"imposta per la risoluzione del contratto è dovuta.La regola, quindi, vale unicamente se tutti hanno optato per il regime della cedolare secca.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
