CONSULENZA TECNICA NEL PROCESSO TRIBUTARIO: FOCUS DEI COMMERCIALISTI


Il Consiglio e la Fondazione Nazionale dei Commercialisti hanno pubblicato un documento di ricerca a supporto, oltre che dei profesisonisti impegnati nel settore della Giustizia Tributaria, anche per quelli che svolgono la funzione di consulente tecnico nel processo tributario.  Nell?"ambito dei poteri istruttori riconosciuti alle Corti di Giustizia tributaria dall?"articolo 7 del D.Lgs. n. 546 del 1992 vi è quello di nominare un consulente tecnico quando occorre acquisire elementi conoscitivi di particolare complessità utili alla decisione della controversia. La corretta individuazione della funzione della consulenza tecnica e degli effetti dell?"indagine peritale svolta, è un tema particolarmente delicato e, secondo i Commercialisti, non può prescindere da considerazioni di più ampio respiro in ordine alla natura del processo tributario. Il documento pubblicato, dal titolo "La consulenza tecnica nel processo tributario", analizzata la figura del consulente tecnico d?"ufficio, le modalità di nomina, accettazione e svolgimento dell?"incarico, ed affronta il tema della vincolatività della consulenza tecnica per il giudice richiedente, anche alla luce dei principali orientamenti espressi in materia dalla giurisprudenza di legittimità.Un ulteriore approfondimento è dedicato al rapporto tra la consulenza tecnica d?"ufficio e quella di parte.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
