OBBLIGO DI ASSICURAZIONE PER CALAMITà NATURALI: DETTAGLI, ADEMPIMENTI E SANZIONI PREVISTE


Dal 2025 tutte le imprese sul territorio dovranno stipulare una polizza di assicurazione per calamità naturali. La legge di Bilancio per il 2024 ha introdotto l?"obbligo per tutte le imprese italiane di stipulare un?"assicurazione contro i danni causati da calamità naturali (art. 1, commi 101 e successivi della legge 213/2023), con scadenza fissata per il 31 dicembre 2024. Nello specifico, il comma 101 cita “Le imprese con sede legale in Italia e le imprese aventi sede legale all?"estero con una stabile organizzazione in Italia, tenute all?"iscrizione nel registro delle imprese ai sensi dell?"articolo 2188 del codice civile, sono tenute a stipulare, entro il 31 dicembre 2024, contratti assicurativi a copertura dei danni ai beni di cui all?"articolo 2424, primo comma, sezione Attivo, voce B-II, numeri 1), 2) e 3), del codice civile direttamente cagionati da calamità naturali ed eventi catastrofali verificatisi sul territorio nazionale. Per eventi da assicurare di cui al primo periodo si intendono i sismi, le alluvioni, le frane, le inondazioni e le esondazioni”. L?"obbligo riguarda dunque tutte le imprese iscritte al Registro delle Imprese con sede legale in Italia, così come le imprese straniere con stabile organizzazione nel territorio italiano. L?"obiettivo della misura è quello di aumentare la resilienza del tessuto imprenditoriale italiano di fronte agli eventi catastrofici sempre più frequenti. Le polizze dovranno coprire i danni ai seguenti tipi di beni: terreni e fabbricati; impianti e macchinari; attrezzature industriali e commerciali. Le imprese dovranno stipulare polizze specifiche per proteggere i beni aziendali dagli eventi catastrofici, quali: sismi; alluvioni; frane; inondazioni; esondazioni. L?"obbligo non si applica ai professionisti e agli imprenditori agricoli, per i quali l?"assicurazione rimane facoltativa. Il mancato adempimento a questo obbligo escluderà le imprese dalle possibilità di ottenere agevolazioni, contributi o sovvenzioni pubbliche in caso di danni derivanti da eventi catastrofici. L?"obbligo scatterà ufficialmente dal 1° gennaio 2025, ma le imprese devono stipulare le polizze entro la fine del 2024 per evitare sanzioni. Le polizze potranno includere un eventuale scoperto o franchigia, ma con un tetto massimo del 15% sul danno subito, per garantire una ripartizione equa dei costi tra l?"impresa e l?"assicurazione. Al momento si è in attesa della pubblicazione del decreto attuativo del Ministero dell?"Economia e delle Finanze e del Ministero delle Imprese e del Made in Italy, che definirà i dettagli operativi per le aziende coinvolte. Tuttavia, è già stato presentato lo schema del decreto interministeriale, che conferma la data di entrata in vigore del 1° gennaio 2025.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
