AGEVOLAZIONI PRIMA CASA SOGGETTI AIRE RIENTRATI IN ITALIA: IL BENEFICIO DECADE SE LA RESIDENZA NON VIENE TRASFERITA ENTRO 18 MESI


  Con Risposta n. 328/E del 2 dicembre l'Agenzia delle Entrate ha chiarito che le agevolazioni "prima casa" spettano ai cittadini trasferiti all?"estero per motivi di lavoro al momento della stipula del contratto di compravendita dell?"immobile situato in Italia. Non spettano, invece, nel caso in cui non venga rispettato il requisito temporale del  trasferimento della residenza nel Comune dell?"abitazione acquistata entro diciotto mesi dall'acquisto. Inoltre non è possibile rettificare, tramite un atto integrativo, la dichiarazione precedentemente resa nell'atto di acquisto in relazione al trasferimento della residenza entro il termine di diciotto mesi dall'acquisto. Laddove, invece, sia ancora pendente il termine di diciotto mesi per il trasferimento della residenza, l'acquirente che si trovi nelle condizioni di non rispettare l'impegno assunto, anche per motivi personali, può revocare la dichiarazione di intenti formulata nell'atto di acquisto dell'immobile presentando un'apposita istanza all'Ufficio presso il quale l'atto è stato registrato e chiedendo la riliquidazione dell'imposta assolta in sede di registrazione, senza applicazione di sanzioni.   • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
