TASSAZIONE DI EMOLUMENTI DIFFERITI: TERMINI CONGRUI ED ESCLUSIONE DALLA TASSAZIONE SEPARATA


Con Sentenza n. 3734/3 del 5 novembre 2024 la Corte di giustizia di secondo grado della Puglia, sulla base del principio già espresso dalla Corte di Cassazione (Sent. n. 15071/2023) secondo il quale, nel caso di produzione di redditi assimilati a lavoro dipendente, non sono soggette a tassazione separata le somme maturate in un determinato anno ed erogate successivamente, ma, comunque, entro un termine congruo, ha confermato la sentenza di prime cure, rigettando l?"appello dell?"Agenzia delle Entrate.Il caso esaminato dalla corte ha riguardato un contribuente,  dipendente dell?"Avvocatura Regionale, che in sede di richiesta di rimborso aveva richiesto l?"applicazione della tassazione “separata” al posto di quella “ordinaria” su alcuni emolumenti erogati nel 2020, ma riferiti a prestazioni lavorative svolte nel 2018. I giudici avevano ritenuto tale termine non congruo. Per valutare la congruità del termine del pagamento, ha chiarito la CGT pugliese, è necessario tener conto di quanto previsto dal regolamento regionale sulla “disciplina dei compensi professionali agli avvocati dell?"Avvocatura Regionale”.
