PER LA VALIDITà DELLA NOTIFICA è IRRILEVANTE LA DEDUZIONE DELL'ILLEGGIBILITà DELLA FIRMA DEL CONSEGNATARIO


Con l'Ordinanza n. 27664 del 25 ottobre la Corte di Cassazione, Sezione Quinta Civile, si è espressa in tema di notifica dell?"avviso di accertamento, ribadendo il principio di diritto secondo cui è irrilevante, ai fini della validità della notificazione, la deduzione della circostanza della illeggibilità della firma del consegnatario, sia in quanto l?"omessa indicazione delle generalità non comporta alcuna nullità, sia in quanto l?"omessa deduzione della estraneità alla sede dell?"impresa del consegnatario non fa venir meno la presunzione di conoscenza dell?"atto da parte del destinatario, una volta accertata, come nella specie, la consegna presso la sede o i locali dell?"impresa. La Suprema Corte, accogliendo il ricorso proposto dall?"ufficio, ha affermato che quando l?"atto venga notificato a mezzo raccomandata presso la sede della società o i locali dell?"impresa, come nel caso di specie, a persona che abbia sottoscritto in maniera illeggibile l?"avviso di ricevimento, qualificatasi come “persona a servizio del destinatario addetto alla ricezione delle notificazioni”, la consegna deve ritenersi validamente effettuata.In tal caso, precisa la Cassazione, deve presumersi che la persona fosse addetta alla ricezione degli atti diretti alla persona giuridica, senza che il notificatore debba accertarsi della sua effettiva condizione. Incombe, infatti, sulla società destinataria della notifica l?"onere di provare la mancanza dei presupposti per la valida effettuazione del procedimento notificatorio.  Fonte: https://www.cortedicassazione.it

  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
