WELFARE AZIENDALE: OK AI FRINGE BENEFIT CON CARTA DI DEBITO NOMINATIVA


Con Risposta n. 5 del 15 gennaio, l'Agenzia delle Entrate fornisce chiarimenti in merito alla corretta applicazione delle disposizioni relative ai fringe benefit in caso di erogazione degli stessi tramite carta di debito nominativa. Proponente l'interpello è società che intende adottare, tramite regolamento aziendale, un piano di welfare che prevede l?"erogazione ai dipendenti di fringe benefit mediante una carta di debito nominativa, affidando il servizio di assegnazione dei fringe benefit a un provider incaricato di attivare un sistema informatico per la predisposizione e gestione del piano. Le carte di debito sono destinate esclusivamente all'acquisto di beni e servizi specifici presso fornitori selezionati, non sono monetizzabili, cedibili a terzi o utilizzabili per operazioni finanziarie. La società chiede se queste carte possano essere considerate "documenti di legittimazione" ai sensi dell'articolo 6, comma 2, del decreto MEF-Ministero del Lavoro del 25 marzo 2016, e costituire un voucher cumulativo, e se, in tal caso, possa considerarsi esentata dall'obbligo di applicazione della ritenuta sul valore dei beni e dei servizi da assegnare ai propri dipendenti. Tenuto conto dei vincoli di spesa conformi al massimale previsto dalla legislazione vigente in materia di fringe benefit e delle modalità di utilizzo della carta presso un numero determinato di esercenti nei settori preventivamente individuati dall'Istante come potenziali erogatori di fringe benefit per i propri dipendenti, chiariscono le Entrrate, la carta di debito assegnata ai dipendenti può avere la funzione di documento di legittimazione ai sensi del comma 3­-bis dell'articolo 51 del Tuir, e può costituire un voucher cumulativo.Pertanto la società, in qualità di sostituto d'imposta, sull'importo utilizzato dai propri dipendenti per l'acquisto dei beni e servizi previsti dal piano di welfare non è tenuta ad applicare la ritenuta a titolo d'acconto.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
