MANCATO INVIO DICHIARAZIONE DI VARIAZIONE CATASTALE PER INTERVENTI CON SUPERBONUS: COME RIMEDIARE


Con Provvedimento del 7 febbraio l'Agenzia delle Entrate definisce il contenuto e le modalità tramite le quali la stessa Agenzia invia le comunicazioni ai contribuenti in caso di mancato invio della dichiarazione di variazione catastale degli immobili interessati dagli interventi agevolati con il Superbonus. Nel Provvedimento sono inoltre indicate le modalità con le quali i contribuenti possono comunicare all?"Agenzia entrate eventuali elementi, fatti e circostanze dalla stessa non conosciuti, in relazione all?"assenza di obbligo di regolarizzazione catastale per gli immobili indicati, e le modalità per regolarizzare errori od omissioni e beneficiare della riduzione delle sanzioni previste per le violazioni stesse. Le comunicazioni inviate dall'Agenzia Entrate al domicilio del contribuente, tramite PEC o raccomandata, contengono: il codice fiscale, denominazione, cognome e nome del contribuente; l'identificativo catastale dell?"immobile indicato dal contribuente nella Comunicazione dell?"opzione relativa agli interventi di recupero del patrimonio edilizio, efficienza energetica, rischio sismico, impianti fotovoltaici e colonnine di ricarica; l'invito a fornire chiarimenti e idonea documentazione tramite il servizio “Consegna documenti e istanze” disponibile nell?"area riservata del sito internet dell?"Agenzia delle entrate, nel caso in cui il contribuente ravvisi inesattezze nei dati in possesso dell?"Agenzia o intenda comunque fornire elementi in grado di giustificare la presunta anomalia. Le stesse comunicazioni sono messe a disposizione anche nel cassetto fiscale del contribuente. I destinatari delle comunicazioni possono regolarizzare le eventuali omissioni presentando le dichiarazioni di cui all'articolo 1, commi 1 e 2, del regolamento di cui al decreto del ministro delle Finanze n. 701/1994, beneficiando così delle sanzioni ridotte, in ragione del tempo trascorso dalla commissione delle violazioni stesse.   • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
