EQUITALIA CHIARISCE: IL PIGNORAMENTO DAL CONTO CORRENTE DEI CONTRIBUENTI SENZA AUTORIZZAZIONE DEL GIUDICE è IN VIGORE DAL 2005


A seguito dell'accorpamento tra Equitalia ed Agenzia delle Entrate in Agenzia delle Entrate-Riscossione, dal 1° luglio il nuovo ente diventerà anche riscossore, con la possibilità, in caso di debiti fiscali o cartelle esattoriali, di pignorare direttamente il conto corrente dei contribuenti che non hanno pagato senza alcuna procedura di autorizzazione da parte di un giudice. Equitalia, pronunciandosi sul tema, in una nota ha chiarito: "Non è vero che a partire dal primo luglio prossimo l'Agenzia delle Entrate Riscossione potrà pignorare i conti correnti dei contribuenti debitori senza l'obbligo di richiedere l'intervento dell'autorità giudiziaria. Le norme che regolano la procedura di pignoramento diretto sono in vigore dal 2005". Inoltre, ha precisato Equitalia, la norma "prevede l'intervento dell'Autorità giudiziaria in via eventuale laddove il terzo pignorato o il contribuente stesso abbiano elementi validi per contestare l'azione dell'Agente della riscossione".

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
