ANTIRICICLAGGIO: AMPLIATA LA PLATEA DELLE PERSONE "POLITICAMENTE ESPOSTE"


Il Consiglio dei Ministri, nella seduta n. 31 del 24 maggio 2017, ha approvato in esame definitivo un decreto legislativo che detta disposizioni più severe in materia di antiriciclaggio e di contrasto al finanziamento delle attività terroristiche. Tra le novità più importanti del Decreto, che recepisce la direttiva Ue 2015/849, possiamo segnalare che: è stata ampliata la platea dei soggetti qualificati come 'persone politicamente esposte' verso le quali devono essere effettuati controlli più approfonditi, contemplando anche i sindaci dei comuni con popolazione non inferiore a 15.000 abitanti e i vertici delle società da questi partecipate; è stato previsto il rafforzamento del ruolo della Direzione antimafia e antiterrorismo; sono state riordinate le sanzioni amministrative con un sistema di misure graduato in funzione della gravità delle violazioni; è stato previsto che le operazioni sospette non possano essere compiute fino a quando non è effettuata la relativa segnalazione e la IUF avrà l'obbligo di dare informazione delle operazioni sospette per motivi di terrorismo anche ai Servizi di sicurezza; è stat istituito il Registro dei titolari effettivi di persone giuridiche e trust ed è stata prevista la centralizzazione, in un'apposita sezione del registro delle imprese, delle informazioni sulla titolarità effettiva dei trust produttivi di effetti fiscali.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
