CHIARIMENTI SULLE PRESTAZIONI SANITARIE IN FARMACIA: ESENZIONE IVA E CERTIFICAZIONE DEI CORRISPETTIVI


L'Agenzia Entrate, con la circolare n. 60/E del 12 maggio 2017, ha fornito chiarimenti in tema di prestazioni sanitarie fornite dalle farmacie. In particolare, l'Agenzia ha chiarito che sono esenti da IVA esclusivamente le prestazioni sanitarie di diagnosi, cura e riabilitazione che vengono effettuate da soggetti abilitati all'esercizio della professione e il metodo corretto per la certificazione dei corrispettivi è lo scontrino parlante, che riporta la specificazione della natura, qualità e quantità dei servizi prestati e il codice fiscale del destinatario.   L'esenzione IVA è quindi subordinata al duplice requisito della natura della prestazione (diagnosi, cura e riabilitazione) e di colui che la rende, cioè soggetti abilitati all'esercizio della professione. Pertanto, sono esenti le prestazioni rese dalle farmacie tramite la messa a disposizione di operatori socio-sanitari quando queste sono richieste da un medico o da un pediatra. Allo stesso modo, non scontano l'IVA le prestazioni di supporto all'utilizzo di dispositivi strumentali per i servizi di secondo livello ove prescritti da medici o pediatri ed erogati "anche" avvalendosi di personale infermieristico. Sono, invece, soggetti all'imposta ad aliquota ordinaria i servizi di prenotazione, riscossione e ritiro dei referti erogati dalle farmacie e le prestazioni analitiche di prima istanza rientranti nell'ambito dell'autocontrollo, solo se queste ultime sono effettuate direttamente dai pazienti tramite apparecchiature automatiche disponibili presso la farmacia.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
