Elenco dei professionisti delegati alla vendita Il Presidente del Tribunale può provvedere a nuove iscrizioni


La Direzione generale del ministero della giustizia, con circolare dell'11 gennaio 2018, prendendo posizione in merito ad alcuni quesiti pervenuti, volti a chiarire se, nelle more dell'emanazione del decreto ministeriale di cui all'art. 5-bis del decreto-legge 3 maggio 2016, n. 59, convertito con modificazioni nella legge 30 giugno 2016, n. 119, il Presidente del Tribunale, investito della richiesta di iscrizione all'elenco dei soggetti specializzati per la custodia e la vendita dei beni mobili iscritti nei pubblici registri e dei beni immobili (artt. 534-bis e 591-bis c.p.c.), debba - nella ricorrenza dei prescritti requisiti - provvedere alla nuova iscrizione ha risposto in senso positivo. Si legge infatti nella citata circolare: "Invero questa Direzione generale - d'intesa anche con l'Ufficio legislativo - ritiene che, allo stato, sia possibile procedere a nuove iscrizioni nell'elenco dei soggetti specializzati per la custodia e la vendita dei beni mobili iscritti nei pubblici registri e dei beni immobili (art. 534-bis e 591-bis c.p.c.), in quanto il comma 5 del citato art. 5-bis prevede che, anche successivamente all'emanazione del decreto ministeriale di cui al riformato art. 179-ter disp. att. c.p.c. (e per un periodo di 12 mesi), "le operazioni di vendita continuano ad essere delegate ad uno dei professionisti iscritti nell'elenco di cui al predetto articolo 179-ter, nel testo vigente prima della data di entrata in vigore della legge di conversione" del decreto-legge 3 maggio 2016, n. 59." Conclude la circolare: "In attesa quindi dell'emanazione del richiamato decreto ministeriale, i Presidenti dei tribunali, investiti della richiesta di iscrizione nell'elenco dei soggetti specializzati per la custodia e la vendita dei beni mobili iscritti nei pubblici registri e dei beni immobili (art. 534-bis e 591-bis c.p.c.), potranno procedere alla nuova iscrizione."
