Assegno divorzile: irrilevante il tenore di vita


E' irrilevante il tenore di vita tenuto durante il matrimonio ai fini dell'assegno divorzile: così ha deciso la Cassazione a Sezioni Unite, con sentenza dell'11 maggio 2018, n. 18287.In materia di assegno divorzile, si è finalmente pronunciata la Cassazione a Sezioni Unite (sentenza dell'11 luglio 2018, n. 18287), sancendo l'irrilevanza del tenore di vita tenuto in costanza di matrimonio come parametro per la determinazione dell'assegno. Il tenore di vita secondo i precedenti orientamenti Con la pronuncia in esame, la Cassazione ha posto fine al contrasto che si era creato tra l'orientamento tradizionale, che voleva che il tenore di vita fosse posto a base dell'assegno divorzile, e la "rivoluzionaria" sentenza Grilli dell'11 maggio 2017, sul caso dell'ex ministro dell'Economia Vittorio Grilli e Lisa Caryl Lowenstein. Con quest'ultima pronuncia, la Cassazione, prima sezione, aveva escluso la rilevanza del tenore di vita, dando rilievo piuttosto al criterio dell'autosufficienza economica dell'ex coniuge, e così ribaltando dei principi ormai considerati pacifici e consolidati. La decisione delle Sezioni Unite Le Sezioni Unite, con sentenza n. 18287/18, hanno essenzialmente confermato quanto statuito dalla sentenza Grilli, ritenendo che la funzione equilibratrice dell'assegno non è finalizzata a ricostruire il tenore di vita endo-coniugale. Per la determinazione dell'assegno è invece fondamentale prendere in considerazione il contributo fornito dal coniuge economicamente più debole alla conduzione della vita familiare e alla formazione del patrimonio comune e personale di ciascuno degli ex coniugi, in relazione alla durata del matrimonio e dell'età dell'avente diritto. E infatti - evidenzia la Corte - la natura e l'entità di tale contributo costituiscono "il frutto di decisioni comuni di entrambi i coniugi, libere e responsabili, che possono incidere anche profondamente sul profilo economico patrimoniale di ciascuno di essi dopo la fine dell'unione matrimoniale". Pertanto, non si può prescindere dalla valutazione di tale contributo, considerando che l'assegno di divorzio ha una funzione assistenziale, e, in pari misura, compensativa e perequativa. In quest'ottica, ai fini del riconoscimento dell'assegno - afferma la Corte - "si deve adottare un criterio composito basato certamente sulla valutazione comparativa delle rispettive condizioni economico-patrimoniali, ma anche che dia particolare rilievo al contributo fornito dall'ex coniuge richiedente alla formazione del patrimonio comune e personale, in relazione alla durata del matrimonio, alle potenzialità reddituali future ed all'età dell'avente diritto. Il parametro così indicato si fonda sui principi costituzionali di pari dignità e di solidarietà che permeano l'unione matrimoniale anche dopo lo scioglimento del vincolo". di Antonella Pedone Fonte: https://www.aduc.it
