LA MANOVRA CORRETTIVA SULLA GAZZETTA UFFICIALE: PUBBLICATO IL D.L. N. 50/2017


E' stato pubblicato, sulla Gazzetta Ufficiale n. 95 del 24 aprile 2017 (Supplemento Ordinario n. 20) il Decreto-legge 24 aprile 2017, n. 50, recante "Disposizioni urgenti in materia finanziaria, iniziative a favore degli enti territoriali, ulteriori interventi per le zone colpite da eventi sismici e misure per lo sviluppo". La manovra correttiva, approvata dal Consiglio dei Ministri nella seduta dell'11 aprile 2017, ammonta a 3,4 miliardi di euro. Il provvedimento contiene una serie articolata di misure in materia di entrate, enti territoriali, giustizia tributaria, in tema di sviluppo economico e infrastrutture, oltre ad interventi per accelerare la ricostruzione delle aree colpite dagli eventi sismici dello scorso anno. Tra le misure in tema di entrate segnaliamo: l'estensione dell'ambito di applicazione del c.d. "Split Payment" (meccanismo della scissione dei pagamenti dell'IVA) anche alle operazioni effettuate nei confronti di altri soggetti che, a legislazione vigente, pagano l'imposta ai loro fornitori secondo le regole generali; misure di contrasto alle compensazioni fiscali indebite (misure antifrode); aumento del prelievo sui giochi; rideterminazione della base ACE (Aiuto alla Crescita Economica). In materia di giustizia tributaria, il decreto prevede la possibilità di chiedere, entro il 30 settembre 2017, la definizione delle liti tributarie nei confronti dell'Agenzia delle Entrate con il pagamento degli importi contestati con l'atto impugnato e degli interessi da ritardata iscrizione a ruolo, al netto di sanzioni e interessi di mora. Tra le disposizioni in materia di enti territoriali segnaliamo la modifica dei criteri di riparto del Fondo di Solidarietà Comunale, un contributo a favore delle province delle regioni a statuto ordinario, la procedura per la determinazione di fabbisogni standard e capacità fiscali standard delle Regioni a statuto ordinario, l'attribuzione della quota investimenti Regioni, e misure in materia di finanziamento del trasporto pubblico locale. Tra gli interventi in favore delle zone terremotate, è stata prevista l'istituzione di un fondo specifico di un miliardo di euro per ciascun anno del triennio 2017-2019 finalizzato a consentire l'accelerazione delle attività di ricostruzione. Il decreto introduce infine una serie di misure per lo sviluppo economico e in materia di infrastrutture; fra queste segnaliamo: maggiori incentivi alle quotazioni con riferimento alle piccole e medie imprese (equity crowfunding); l'estensione temporale delle agevolazioni per le start-up innovative; norme per agevolare la finanza di progetto nell'ammodernamento degli impianti sportivi pubblici; misure per la qualità del trasporto pubblico locale; adeguamento delle linee ferroviarie regionali agli standard di sicurezza nazionali; l'allineamento del regime patent box alle linee guida OCSE; il passaggio dell'assistenza sanitaria agli stranieri dal Ministero dell'Interno al Ministero della Salute; disposizioni in materia di eventi sportivi: "Ryder Cup 2022", finali di coppa del mondo di sci a marzo 2020 e campionati mondiali di sci alpino di Cortina d'Ampezzo nel febbraio 2021.
