CATTIVA CONSERVAZIONE DEGLI ALIMENTI: PER LA CONFIGURAZIONE DEL REATO NON SONO NECESSARIE ANALISI DI LABORATORIO O PERIZIE


La Terza Sezione Penale della Corte di Cassazione, con la sentenza n. 39318 del 9 maggio 2018 ha affermato che il reato di detenzione per la vendita di sostanze alimentari in cattivo stato di conservazione (art. 5, lett. b), della legge 30 aprile 1962, n. 283) si configura nel momento in cui "è accertato che le concrete modalità di conservazione siano idonee a determinare il pericolo di un danno o deterioramento dell'alimento, senza che rilevi a tal fine la produzione di un danno alla salute, attesa la sua natura di reato di danno a tutela del c.d. ordine alimentare, volto ad assicurare che il prodotto giunga al consumo con le garanzie igieniche imposte dalla sua natura". E' dunque necessario accertare, continua la Suprema Corte, che le modalità di conservazione siano in concreto idonee a determinare il pericolo di un danno o deterioramento delle sostanze "escludendosi, tuttavia, la necessità di analisi di laboratorio o perizie, ben potendo il giudice di merito considerare altri elementi di prova, come le testimonianze di soggetti addetti alla vigilanza, quando lo stato di cattiva conservazione sia palese e, pertanto, rilevabile a seguito di una semplice ispezione".
