PRIVACY: CON LA DEFINIZIONE AGEVOLATA SANZIONI RIDOTTE PER LE CONTESTAZIONI PENDENTI


Sul sito internet del Garante per la protezione dei dati personali sono state pubblicate specifiche indicazioni operative utili a chiarire, a soggetti pubblici e privati, come usufruire della definizione agevolata dei procedimenti sanzionatori pendenti. Si ricorda che l'agevolazione è stata prevista dal recente decreto legislativo 101/2018, che ha adeguato la normativa italiana alle disposizione del Regolamento europeo 2016/679 in materia di privacy. Le FAQ sono disponibili sul sito del Garante Privacy. A decorrere dal 19 settembre, chi intendesse avvalersi di questa facoltà, potrà oblare le sanzioni mediante il pagamento in misura ridotta di una somma pari ai due quinti del minimo edittale stabilito per la sanzione. Il pagamento dovrà essere effettuato entro il 18 dicembre 2018. Potranno usufruire di questa speciale procedura quanti abbiamo ricevuto entro il 25 maggio 2018, data di piena applicazione del Regolamento Ue, l'atto con il quale sono stati notificati gli estremi della violazione o l'atto di contestazione. Tra le altre istruzioni, le FAQ specificano anche: le modalità per il pagamento delle sanzioni; l'importo da pagare per ciascuna violazione commessa; i casi di esclusione dalle agevolazioni. Statement on the GDPR (General Data Protection Regulation)

The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
