PEC irregolari: le conseguenze della mancata regolarizzazione


Dallo scorso 1° giugno 2016, il Registro Imprese ha avviato la procedura prevista dal MISE per la cancellazione degli indirizzi PEC (posta elettronica certificata) non più attivi, revocati e non univoci (cioè non riferibili a un'unica impresa o riferibili a un professionista anziché all'impresa).Ogni primo giorno del mese (escluso il mese di agosto) saranno pubblicati gli elenchi di imprese per cui dalle verifiche automatiche si è riscontrato che l'indirizzo PEC non è conforme alle vigenti disposizioni. Ogni impresa indicata negli elenchi deve regolarizzare l'iscrizione del proprio indirizzo di posta elettronica certificata, entro 45 giorni dalla pubblicazione dell'elenco all'Albo Camerale, mediante due procedure alternative tra loro: l'iscrizione di un nuovo indirizzo di posta elettronica certificata, presentando quindi una pratica di variazione; comunicazione all'Ufficio Conservatore della Camera di Commercio qualora venisse rinnovato l'indirizzo PEC già dichiarato. Decorso il termine dei 45 giorni l'ufficio chiederà al Giudice del Registro delle imprese di cancellare l'indirizzo PEC non regolare. La mancata regolarizzazione comporterà inoltre: la sospensione delle domande di iscrizione presentate successivamente al decreto di cancellazione emesso dal Giudice del Registro per un termine massimo di 3 mesi per le società e un termine massimo di 45 giorni per le imprese individuali, con invito a iscrivere un indirizzo PEC valido ed univoco; l'applicazione delle sanzioni amministrative pecuniarie di cui all'articolo 2630 del codice civile per le società e di cui all'articolo 2194 c.c. per le imprese individuali poiché l'omessa comunicazione entro i suddetti termini comporta il rigetto dell'istanza, che si intende come "non presentata". Sui siti internet di gran parte delle Camere di Commercio sono pubblicati gli elenchi degli indirizzi PEC riscontrati come inattivi. Ne segnaliamo alcuni: Milano Bologna Torino Verona Ricordiamo che la Posta Elettronica Certificata è ormai diventata la principale modalità adottata dalla Pubblica Amministrazione (e anche da molti privati) per la notifica di atti (ad esempio, avvisi di pagamento, accertamenti fiscali, ingiunzioni) il cui mancato riscontro entro un certo numero di giorni comporta la loro definitività o esecutività. E' pertanto fondamentale tenere monitorato quotidianamente l'indirizzo di Posta Elettronica Certificata.

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
