Esecuzioni Immobiliari: pagamento contributo pubblicazione sul Portale delle Vendite Pubbliche. Criticità e novità


Ad ormai due anni dall'entrata in vigore, dopo l'utilizzo continuativo del sistema, abbiamo rivisto passo - passo le modalità operative per il pagamento telematico dei diritti per la pubblicazione degli avvisi di vendita sul Portale delle Vendite Pubbliche e provvediamo, a beneficio dei lettori, a dare conto delle persistenti criticità del sistema e delle positive novità riscontrate (e probabilmente non da tutti colte) ad aggiornamento di quanto da noi scritto in un articolo pubblicato sui siti del circuito www.ateneoweb.com nel febbraio 2018. Pubblicità obbligatoria sul PVP Ricordiamo che, a partire dal 19 febbraio 2018, per effetto della modifica dell'art. 490 c.p.c., la pubblicità degli avvisi di vendita degli immobili deve essere obbligatoriamente effettuata mediante pubblicazione sul "Portale delle vendite pubbliche" all'interno di un'area del sito del Ministero della giustizia (attualmente all'indirizzo https://pvp.giustizia.it). La pubblicazione dell'avviso sul sito https://pvp.giustizia.it avviene a seguito del pagamento del Contributo di € 100,00 richiesto per ogni singolo lotto e comprovato dall'allegazione della relativa ricevuta. Le conseguenze della omessa pubblicità sul portale delle vendite pubbliche sono molto pesanti e comportano l'impossibilità di procedere alla vendita. Il difetto di attuazione della pubblicità, o un suo vizio, determina la nullità (da far valere con l'opposizione agli atti esecutivi di cui all'art. 617 del c.p.c.) dell'atto esecutivo, al quale la pubblicità si riferisce. La mancata effettuazione nei termini della pubblicità sul P.V.P. è causa di estinzione del processo esecutivo. Naturalmente, prima di effettuare il pagamento dei diritti, occorre verificare che il Creditore procedente abbia versato il fondo spese e che non vi siano insoluti per aste precedenti o altri problemi che rendano impossibile la pubblicazione, in quanto il versamento dei diritti non è generico, ma riferito alla singola procedura esecutiva, e la richiesta di rimborso (unica procedura di rimedio in caso di errore) non verrà probabilmente esaudita in tempi brevi.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
