Aumentati i giorni di congedi per i padri lavoratori dal 2020


Con la presente circolare si comunica che a partire dal 1° gennaio 2020, il periodo di congedo di paternità obbligatorio è stato aumentato a 7 giorni, ed è stato confermato che è inoltre possibile utilizzare una ulteriore giornata facoltativa in sostituzione di un giorno di congedo obbligatorio della madre. Pertanto, l'INPS, con Messaggio del 21 febbraio 2020 n. 679, ha voluto dare delle chiarificazioni su come va presentata la domanda, confermando che l'istanza di congedo all'INPS è da presentare solo per i lavoratori padri che ricevono l'indennità direttamente dall'Istituto. CONGEDO DI PATERNITA': A CHI SPETTA, IN QUALI MISURE ED ENTRO QUALI TERMINI? Il congedo obbligatorio è utilizzabile se sussistono le seguenti condizioni: i figli sono nati, adottati o affidati dal 1° gennaio 2020 al 31 dicembre 2020; nella misura di 7 giorni (si ricorda che fino al 31 dicembre 2019 i giorni erano 5); entro 5 mesi dalla nascita oppure dall'ingresso in famiglia del minore, o dall'entrata in Italia in caso di adozione internazionale. Oltre al congedo obbligatorio per il lavoratore padre c'è anche il congedo facoltativo che presenta le seguenti caratteristiche: la durata è di 1 giorno, previo accordo con la madre ed in sostituzione di una giornata di astensione obbligatoria spettante a quest'ultima; entro 5 mesi dalla nascita oppure dall'ingresso in famiglia del minore, o dall'entrata in Italia in caso di adozione internazionale. SE I 5 MESI ENTRO I QUALI AVER DIRITTO AL CONGEDO DI PATERNITA' SONO INIZIATI NEL 2019 E TERMINANO NEL2020? Comunque spettano 5 (e non 7) giorni di congedo di paternità. QUANDO IL LAVORATORE PADRE RICEVE L'INDENNITA'? L'indennità è corrisposta dal datore di lavoro, al termine di ogni periodo di paga, tenendo presente l'eventuale conguaglio in un secondo tempo con i contributi e le somme dovute all'Istituto previdenziale. TRATTAMENTO NORMATIVO E PREVIDENZIALE DEL CONGEDO DI PATERNITA' SIA OBBLIGATORIO SIA FACOLTIATIVO Si evidenza che i giorni di congedo di paternità sia obbligatorio sia facoltativo: valgono ai fini dell'anzianità di servizio; valgono ai fini della maturazione tredicesima mensilità e delle ferie; per avere accesso all'utilizzo dei giorni di congedo non è necessaria una minima anzianità contributiva pregressa per poter accreditare i contributi figurativi per il diritto alla pensione e per il calcolo della misura di tale diritto; non si possono frazionare ad ore; si applicano le disposizioni previste in materia di congedo di paternità indicate nel D.Lgs n. 151/2001 che affronta il discorso del trattamento previdenziale sia per il periodo di congedo di maternità intercorso in costanza di rapporto di lavoro, sia per il periodo corrispondente al congedo di maternità trascorso al di fuori del rapporto. MODALITÀ DI PRESENTAZIONE DELLA DOMANDA Per beneficiare del congedo obbligatorio e facoltativo, i lavoratori per i quali il pagamento delle indennità è erogato direttamente dall'Istituto devono presentare autonoma domanda allo stesso; mentre per tutti i lavoratori, per i quali le indennità sono anticipate dal datore di lavoro, devono solo comunicare in forma scritta l'assenza al datore di lavoro, senza necessità di presentare domanda all'INPS. In tale ultimo caso, infatti, sono i datori di lavoro che comunicano all'INPS le giornate di congedo fruite attraverso il flusso UniEmens.
