In una compagine costituita da un ristretto numero di persone, è elevata la probabilità, in assenza di prova contraria, che le movimentazioni siano da ascriversi alla stessa. In tema di accertamenti bancari, l'utilizzazione dei dati risultanti dalle copie dei conti correnti bancari acquisiti dagli istituti di credito non può ritenersi limitata, in caso di società di capitali, ai conti formalmente intestati all'ente, ma riguarda anche quelli intestati ai soci, agli amministratori o ai procuratori generali allorché risulti provata dall'amministrazione finanziaria, anche tramite presunzioni, la natura fittizia dell'intestazione o, comunque, la sostanziale riferibilità all'ente anche di alcuni singoli dati, senza necessità di provare altresì che tutte le movimentazioni di tali rapporti rispecchino operazioni aziendali. Lo ha stabilito la Corte di cassazione con l'ordinanza n. 21424 del 15 settembre 2017, con cui ha rigettato il motivo di ricorso presentato da una Srl in liquidazione. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
