NUOVO ANTIRICICLAGGIO: CONTRATTI DI LOCAZIONE CON DUBBI


Le risposte alle FAQ pubblicate la settimana scorsa dal MEF hanno destato qualche perplessità relativamente a quanto indicato in merito agli obblighi derivanti dalla stipula di contratti di locazione. Ho quindi ritenuto opportuno inviare una richiesta di chiarimenti, di cui riporto testualmente il contenuto. Nelle FAQ pubblicate relativamente agli obblighi derivanti dalla stipula di contratti di locazione si ha modo di leggere che per la verifica della soglia dei 15.000 euro "..è quello realtivo al canone complessivo contrattualmente stabilito, anche tenuto conto della durata del contratto medesimo...". In merito sono nate alcune perplessità, stante che solitamente nei contratti di locazione viene stabilito un canone annuale, che hanno fatto nascere il dubbio che si debba aver riguardo al canone stabilito per tutta la durata del contratto (es. stipula di un contratto di locazione con canone annuo di 10.000 euro, inferiore alla soglia, durata anni 4, "canone complessivamente stabilito....tenuto conto della durata del contratto" euro 40.000 superiore alla soglia). Nelle precedenti risposte alle FAQ (11.11.2013) era stato indicato "il periodo di riferimento temporale da prendere in considerazione ai fini del raggiungimento della soglia, pari o superiore a 15.000 euro, che impone l'obbligo di registrazione delle operazioni di cui all'articolo 36 del d.lgs. 231/2007, è quello relativo al canone mensile, ovvero periodico (se concordata una diversa base di periodicità), risultante dal contratto di locazione sottoscritto dalle parti"; in considerazioni di tale risposta si era pervenuti alla seguente conclusione (nell'ipotesi di contratto con pagamento di canoni mensili): canone mensile sino a 14.999,99 euro nessun obbligo di registrazione della prestazione; canone mensile da 15.000,00= euro obbligo di registrazione della prestazione. Si chiede quindi di voler cortesemente precisare ulteriormente la risposta alla faq ora pubblicata. Note: Nelle risposte alle FAQ del MEF - Dipartimento del Tesoro - è indicato che eventuali interrogativi vanno inoltrati unicamente a mezzo di posta elettronica all'indirizzo dt.antiriciclaggio@dt.tesoro.it. Ho provato ad inviare un messaggio a tale indirizzo ma ho ottenuto la seguente risposta: Il tuo messaggio per dt.antiriciclaggio@dt.tesoro.it non è stato recapitato perché il dominio dt.tesoro.it risulta inesistente.   • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
