La compensazione orizzontale del credito IVA 2020


I contribuenti che hanno presentato la dichiarazione IVA 2021 o che la presenteranno entro il termine fissato per il 30 aprile 2021 hanno la possibilità di procedere alla compensazione orizzontale dei crediti IVA eccedenti i 5.000 euro maturati nel corso del periodo d'imposta 20120, a partire dal decimo giorno successivo a quello di presentazione della dichiarazione. Il limite di 5.000 euro è aumentato a 50.000 euro annui per le start-up innovative, per il periodo di iscrizione nella sezione speciale del Registro delle imprese. Analogo incremento ai fini dell'esonero dall'obbligo del visto di conformità è previsto, in caso di utilizzo in compensazione del credito IVA relativo alla dichiarazione dell'anno 2020 per un importo non superiore a 50.000 euro, in presenza di un livello di affidabilità conseguente all'applicazione degli indici sintetici di affidabilità fiscale almeno pari a 8 oppure a 8,5 (media semplice dei livelli di affidabilità 2018 e 2019). Ricordiamo che il limite complessivo di 700mila euro per le compensazioni orizzontali di crediti d'imposta opera per ciascun anno solare (e non per modello dichiarativo). Rappresenta quindi il limite massimo dei crediti di imposta e dei contributi compensabili ovvero rimborsabili ai soggetti intestatari di conto fiscale in un anno solare. Tale limite non è però applicabile quando specifiche disposizioni di legge lo prevedano: è il caso di molti crediti di imposta, normalmente di natura agevolativa (per esempio il credito d'imposta per investimenti in attività di ricerca e sviluppo ex articolo 3 del decreto-legge n. 145 del 2013.

  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
