AVVISI DI ACCERTAMENTO - DAL 1° LUGLIO 2017 NOTIFICA VIA PEC ANCHE PER ENTI NON COMMERCIALI E ASSOCIAZIONI


Anche i contribuenti non obbligati a dotarsi di un indirizzo di posta elettronica certificata (PEC) censito presso l'INI-PEC possono richiedere, su base facoltativa, la notifica telematica degli avvisi di accertamento emessi a partire dal 1° luglio 2017. Secondo quanto stabilito dall'art. 7-quater del D.L. n. 193/2016, recante "Disposizioni urgenti in materia fiscale e per il finanziamento di esigenze indifferibili" (c.d. "Decreto fiscale"), convertito dalla L. n. 225/2016, a partire dal 1° luglio 2017 la notifica da parte dell'Agenzia delle Entrate degli avvisi di accertamento e degli altri atti che per legge devono essere notificati a imprese e professionisti iscritti in Albi o Elenchi  può essere effettuata direttamente dal competente ufficio all'indirizzo PEC risultante dall'Indice nazionale degli indirizzi di posta elettronica certificata (INI-PEC). A tal fine è necessario che i contribuenti persone fisiche (compresi i non residenti iscritti all'AIRE, ovvero i soggetti stranieri non residenti), le associazioni, i condomini e gli enti non commerciali. comunichino il proprio indirizzo PEC o quello di un soggetto delegato, utilizzando il modello approvato dall'Agenzia delle Entrate con il provvedimento del 3 marzo 2017, Prot. 44027/2017, recante "Approvazione del modello e delle relative istruzioni per comunicare i dati relativi all'indirizzo di posta elettronica certificata per la notifica degli atti, ai sensi dell'articolo 60, settimo comma, del decreto del Presidente della Repubblica 29 settembre 1973, n. 600". The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
