ADEMPIMENTO SPONTANEO OBBLIGHI TRIBUTARI SOGGETTI IVA: DALLE ENTRATE LE INDICAZIONI PER RICONTROLLARE IL VOLUME D'AFFARI


Al fine di stimolare l'assolvimento degli obblighi tributari e favorire l'emersione spontanea delle basi imponibili l'Agenzia delle Entrate mette a disposizione dei soggetti passivi IVA le informazioni derivanti dal confronto delle comunicazioni dei dati delle fatture emesse e ricevute, da cui risulterebbe che sia stato omesso, in tutto o in parte, di dichiarare il volume d'affari conseguito. Con il Provvedimento dell'8 novembre, in particolare, sono chiarite le modalità con cui queste informazioni sono messe a disposizione dei contribuenti. L'Agenzia delle Entrate invia una comunicazione all'indirizzo PEC dei contribuenti interessati, che sarà disponibile anche nel "cassetto fiscale" del destinatario, contenente i dati utili relativi all'anomalia riscontrata. I contribuenti o gli intermediari incaricati alla trasmissione delle dichiarazioni, a loro volta, possono richiedere informazioni o segnalare all'Agenzia tramite PEC eventuali elementi, fatti e circostanze dalla stessa non conosciuti. Gli stessi infine, una volta verificato il volume d'affari e venuti a conoscenza dell'esattezza delle informazioni fornite dall'amministrazione finanziaria, possono regolarizzare gli errori o le omissioni commessi avvalendosi del ravvedimento operoso (articolo 13, Dlgs 472/1997), beneficiando quindi della riduzione delle sanzioni in ragione del tempo trascorso dalla commissione delle violazioni stesse. The data controller is Studio Dorighelli, who states that the data acquired in this manner will be handled as follows:

  • it will be used to comply with current requests for information/acquistion/registration until completed and for no other purpose.
  • it will be held in the company archives with no deadline, until independent cancellation by the user, voluntary cancellation by the Controller or an explicit request for cancellation by the user.
  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
