MARCHI DI IMPRESA E MARCHIO DI IMPRESA UE - DELEGA AL GOVERNO PER L'ADEGUAMENTO DELLA NORMATIVA NAZIONALE A QUELLA EUROPEA


E' stata pubblicata, sulla Gazzetta Ufficiale n. 259 del 6 novembre ottobre 2017, la Legge 25 ottobre 2017, n. 163, recante "Delega al Governo per il recepimento delle direttive europee e l'attuazione di altri atti dell'Unione europea - Legge di delegazione europea 2016-2017". L'articolo 3, modificato durante l'esame in Commissione al Senato, contiene la delega al Governo per l'attuazione della direttiva (UE) n. 2015/2436 sul ravvicinamento delle legislazioni degli Stati membri in materia di marchi di impresa, nonché per l'adeguamento della normativa nazionale alle disposizioni del Regolamento (UE) n. 2015/2424 sul marchio d'impresa dell'UE. I due provvedimenti europei da attuare costituiscono il cosiddetto "pacchetto marchi", diretto a una maggiore armonizzazione tra gli ordinamenti degli Stati membri, al fine di superare le disparità esistenti tra i titolari di marchi nei diversi Paesi. La Direttiva (UE) 2015/2436 mira ad un più stringente ravvicinamento delle legislazioni sostanziali e procedurali degli Stati membri in materia di marchi di impresa, muovendosi in sostanziale simmetria con le modifiche adottate con il Regolamento (UE) n. 2424/2015 relativo al marchio d'impresa UE. Il Regolamento (UE) n. 2015/2424 ha introdotto importanti innovazioni per ciò che concerne i segni idonei a costituire marchio UE, lo snellimento delle procedure per la registrazione del marchio UE, e la riorganizzazione dell'«Ufficio per l'armonizzazione nel mercato interno (marchi, disegni e modelli)» che è stato sostituito con «Ufficio dell'Unione europea per la proprietà intellettuale» (UIPO). L'articolo 3 della L. n. 163/2017 stabilisce i principi e criteri specifici sulla base dei quali deve essere esercitata la delega, che si aggiungono a quelli generali contenuti nella legge n. 234/2012 (recante "Norme generali sulla partecipazione dell'Italia alla formazione e all'attuazione della normativa e delle politiche dell'Unione europea"). I principi e criteri specifici prevedono in particolare di: adeguare le disposizioni del Codice della proprietà industriale (decreto legislativo n. 30/2015) alle previsioni della direttiva e del regolamento, abrogando espressamente le disposizioni superate; salvaguardare la possibilità di adottare disposizioni attuative della direttiva anche attraverso decreti ministeriali di natura regolamentare, nelle materie non coperte da riserva di legge; prevedere, in conformità alla direttiva, i casi in cui un marchio debba essere escluso dalla registrazione o, se registrato, debba essere dichiarato nullo o decaduto; prevedere il diritto di vietare l'uso di un segno a fini diversi da quello di contraddistinguere prodotti o servizi; aggiornare la disciplina in materia di marchi collettivi, coordinandola con quella dei marchi di garanzia o di certificazione; adeguare la normativa nazionale alle disposizioni europee sui marchi di certificazione; prevedere una procedura amministrativa efficiente e rapida per la decadenza o la dichiarazione di nullità del marchio, fatto salvo il diritto delle parti al ricorso davanti agli organi giurisdizionali; modificare la disciplina delle procedure dinanzi alla Commissione dei ricorsi contro i provvedimenti dell'Ufficio italiano brevetti e marchi. L'adozione di uno o più decreti legislativi di attuazione della delega deve avvenire entro dodici mesi dalla data di entrata in vigore della legge di delegazione europea. I decreti devono essere emanati previo parere delle Commissioni parlamentari competenti per materia e di quelle competenti per i profili finanziari.
