SENTENZA DELLA CORTE UE: L'ESCLUSIONE DELLA RETTIFICA DELLA BASE IMPONIBILE IVA IN CASO DI PROCEDURA CONCORSUALE è CONTRARIA AL PRINCIPIO DI NEUTRALITà DELL'IVA


La Corte di Giustizia UE, con sentenza del 23 novembre 2017, ha stabilito che non è conforme al diritto dell'Unione la direttiva IVA nazionale, secondo cui, a fronte del mancato pagamento di una prestazione o cessione, la possibilità di emettere nota di variazione da parte del fornitore è subordinata al verificarsi dell'infruttuosità di una procedura concorsuale, la cui durata media supera i 10 anni. L'Amministrazione finanziaria ha interpretato "infruttuosità" non quale mera pendenza della procedura. Ad esempio per la procedura fallimentare, per emettere la nota di credito, occorrerebbe attendere la pubblicazione del decreto con il quale il Giudice delegato ha approvato il piano di riparto, o ancora più prudentemente il decorso del termine entro cui i creditori possono proporre osservazioni al piano di riparto. Il fornitore italiano deve quindi versare l'IVA senza però averla riscossa dal cliente. I soggetti passivi italiani hanno uno svantaggio in termini di liquidità rispetto ai soggetti passivi IVA di altra stati membri dell'Unione, e ciò, ha stabilito la Corte, risulta essere contrario alle norme UE in materia d'IVA.

  • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
