PRATICHE COMMERCIALI SCORRETTE - L'AGCM SANZIONA TRE ISTITUTI DI CREDITO PER 11 MILIONI DI EURO


L' Agenzia Garante della Concorrenza e del Mercato (AGCM) ha reso noto, tramite comunicato sul proprio sito istituzionale, che con la chiusura di tre procedimenti, sono stati sanzionati, per pratiche commerciali scorrette, i seguenti tre istituti bancari: UniCredit S.p.A., per di 5 milioni di euro; Banca Nazionale del Lavoro S.p.A., per 4 milioni di euro; Intesa San Paolo S.p.A., per 2 milioni di euro, per un ammontare complessivo di 11 milioni di euro. Le tre banche hanno adottato condotte aggressive, in violazione degli articoli 24 e 25 del Codice del Consumo, aventi ad oggetto la pratica dell'anatocismo bancario, ovvero il calcolo degli interessi sugli interessi a debito nei confronti dei consumatori. Tali condotte sono state poste in essere in un quadro normativo in evoluzione che attualmente ne consente l'applicazione solo ed esclusivamente per gli interessi che il cliente autorizzi preventivamente ad addebitare sul conto corrente. In tale contesto, ad esito dell'attività istruttoria è emerso che le banche hanno attuato una politica di forte spinta all'acquisizione delle autorizzazioni all'addebito in conto corrente nei confronti della clientela adottando varie strategie con le quali i clienti sono stati sollecitati a concedere l'autorizzazione, nel presupposto che l'addebito in conto corrente degli interessi debitori fosse il modus operandi ordinario e senza considerare le conseguenze di tale scelta in termini di conteggio degli interessi sugli interessi debitori. Tale strategia è stata sostenuta da varie azioni finalizzate all'acquisizione delle autorizzazioni da parte della clientela che ancora non aveva effettuato la scelta, attraverso sollecitazioni e monitoraggio da parte della rete e delle funzioni/strutture interne coinvolte, sia sui canali fisici (posta e filiali), sia sull'internet banking. Ciò è avvenuto con l'uso di comunicazioni personalizzate precompilate, email e pop-up nella homepage delle aree clienti volti all'attivazione delle procedure di autorizzazione on line preventiva all'addebito in conto degli interessi debitori che non consentivano al consumatore di fornire il diniego espresso all'autorizzazione.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
