LEGGE DI STABILITà 2018: DETRAZIONI PER LA RIQUALIFICAZIONE ENERGETICA


La Legge di Bilancio 2018 ha prorogato al 31 dicembre 2018 le detrazioni IRPEF/IRES, in generale nella misura del 65%, per le spese sostenute in relazione a determinate tipologie di interventi mirati alla riqualificazione energetica di edifici esistenti. È stata però ridotta al 50% l'aliquota di detrazione per gli interventi di acquisto e posa in opera di finestre comprensive di infissi e schermature solari. Sono state altresì rimodulate al 50% le detrazioni per gli interventi di sostituzione di impianti di climatizzazione invernale con impianti dotati di caldaie a condensazione con efficienza almeno pari alla classe A. La detrazione spetta invece nella misura del 65% per: gli interventi di sostituzione di impianti di climatizzazione invernale con impianti dotati di caldaie a condensazione di efficienza almeno pari alla classe A e contestuale installazione di sistemi di termoregolazione evoluti, gli interventi di sostituzione di impianti di climatizzazione invernale con impianti dotati di apparecchi ibridi, costituiti da pompa di calore integrata con caldaia a condensazione, assemblati in fabbrica e concepiti dal fabbricante per funzionare in abbinamento tra loro, le spese sostenute per l'acquisto e la posa in opera di generatori d'aria calda a condensazione. Si applica la detrazione del 50% (fino a un valore massimo di detrazione pari a 30.000 euro) per l'acquisto e la posa in opera di impianti di climatizzazione invernale con impianti dotati di generatori di calore alimentati da biomasse combustibili. È stata introdotta la detrazione del 65% per l'acquisto e la posa in opera di micro-cogeneratori in sostituzione di impianti esistenti. Il beneficio della detrazione spetta ora anche agli IACP (Istituti Autonomi per le Case Popolari), e agli enti aventi le stesse finalità, e alle cooperative di abitazione a proprietà indivisa per interventi su immobili posseduti e assegnati in godimento ai propri soci. Le detrazioni sono suddivise in 10 rate annuali di pari importo. Per beneficiare dell'agevolazione fiscale è necessaria l'asseverazione di un tecnico abilitato e la trasmissione, entro 90 giorni dal collaudo, dei dati contenuti nella certificazione energetica all'ENEA. Le detrazioni previste per gli interventi di riqualificazione energetica si applicano anche per gli interventi relativi a parti comuni di edifici condominiali. La detrazione però spetta nella misura del 70% nel caso in cui i lavori interessino l'involucro dell'edificio con un'incidenza maggiore del 25% della superficie disperdente lorde dell'edificio medesimo o nella misura del 70% se gli interventi hanno il fine di migliorare la prestazione energetica invernale ed estiva. La Legge di Bilancio 2018 ha esteso a tutti i contribuenti la possibilità di cedere le detrazioni spettanti per interventi di riqualificazione energetica.
