INDIRIZZO DI PEC - DEFINITE LE MODALITà DI COMUNICAZIONE ALL'AGENZIA DELLE ENTRATE TRAMITE SERVIZI TELEMATICI


Le persone fisiche e gli altri soggetti, con indirizzo non inserito nell'Indice Nazionale degli Indirizzi di Posta Elettronica Certificata (INI-PEC), possono comunicare solo in modalità telematica la posta elettronica certificata (PEC) per la notifica degli atti impositivi, a partire dal 1° luglio 2017. Lo ha stabilito l'Agenzia delle Entrate con il provvedimento del 28 giugno 2017, Prot. n. 120768, con il quale vengono anche definite le modalità di comunicazione, tramite i servizi telematici dell'Agenzia stessa. Ricordiamo che il settimo comma dell'articolo 60 del D.P.R. n. 600/1973, introdotto dall'articolo 7-quater del D.L. 22 ottobre 2016, n. 193, recante "Disposizioni urgenti in materia fiscale e per il finanziamento di esigenze indifferibili" (c.d. "Decreto fiscale"), convertito dalla legge 1° dicembre 2016, n. 225, consente, ai soggetti diversi da quelli obbligati ad avere un indirizzo PEC risultante dall'INI-PEC e nelle more della piena operatività dell'anagrafe nazionale della popolazione residente, di comunicare un indirizzo di posta elettronica certificata di cui sono intestatari ovvero è intestatario uno dei soggetti di cui all'articolo 12, comma 3, del DF.Lgs. 31 dicembre 1992, n. 546, oppure il coniuge o un parente/affine entro il quarto grado di cui all'articolo 63, secondo comma, secondo periodo, del D.P.R. n. 600/1973, specificamente incaricati di ricevere la notifica per conto degli interessati. Il citato articolo 7-quater, nono comma, ha, inoltre, modificato anche l'articolo 26, secondo comma, del D.P.R. n. 602/1972, prevedendo che, per tali soggetti che ne fanno richiesta, la notifica delle cartelle di pagamento e degli atti della procedura di riscossione coattiva mediante ruolo possa avvenire all'indirizzo PEC dichiarato all'atto della richiesta. Con il Provvedimento in commento vengono disciplinate le modalità di comunicazione, tramite i servizi telematici dell'Agenzia delle Entrate, dei dati relativi all'indirizzo di posta elettronica certificata (PEC) presso cui ricevere la notifica degli atti della stessa Agenzia e dell'agente della riscossione. La modalità di notifica tramite PEC si applica alle notificazioni degli avvisi e degli altri atti effettuate a decorrere dal 1° luglio 2017, ai sensi dell'articolo 7-quater, settimo comma. Il provvedimento interessa unicamente: le persone fisiche, residenti e non residenti; i soggetti diversi dalle persone fisiche; che non sono obbligati per legge a dotarsi di un indirizzo PEC inserito nell'Indice Nazionale degli Indirizzi di Posta Elettronica Certificata (INI-PEC). L'Ufficio ha peraltro precisato che l'indirizzo comunicato può essere utilizzato anche dall'agente della riscossione per la notifica di cartelle di pagamento e degli atti relativi alla procedura di riscossione. La trasmissione dei dati relativi all'indirizzo PEC, tramite i servizi telematici , sostituisce la presentazione del modello ed il punto 4 "Reperibilità del modello" del Provvedimento del Direttore dell'Agenzia delle entrate Prot. n. 44027/2017 del 3 marzo 2017 è soppresso.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
