PAGAMENTI DIGITALI E BIGLIETTAZIONE ELETTRONICA


E' stata pubblicata, sulla Gazzetta Ufficiale n. 189 del 14 agosto 2017, la Legge 4 agosto 2017, n. 124, recante "Legge annuale per il mercato e la concorrenza". I commi 47-53, dell'articolo 1 della legge in esame, introducono misure volte a favorire i pagamenti digitali e le erogazioni liberali attraverso strumenti di pagamento in mobilità anche con l'addebito diretto su credito telefonico. Più nel dettaglio il comma 47 prevede la possibilità di utilizzare la bigliettazione elettronica attraverso strumenti di pagamento in mobilita?, anche con l'addebito diretto su credito telefonico, per l'acquisto di titoli d'accesso a luoghi di cultura, manifestazioni culturali e spettacoli, secondo quanto previsto dall'articolo 8, comma 3, del decreto-legge n. 179 del 2012. Ricordiamo che tale ultima disposizione ha previsto l'introduzione delle modalità di pagamento sopra descritte nel settore del trasporto pubblico locale e la creazione di sistemi di bigliettazione elettronica. La legge n. 147 del 2013 (legge di stabilità per il 2014) ha successivamente esteso la citata modalità di pagamento anche ai servizi di parcheggio, di bike sharing, di accesso ad aree a traffico limitato e di analoghi sistemi di mobilità e trasporto. Per evitare situazioni di insolvenza, il comma 48 ha previsto che l'utente che intende usufruire delle modalità di pagamento di cui al comma 47 sia messo nelle condizioni di conoscere, durante l'operazione di acquisto, se il proprio credito telefonico sia sufficiente e quanto residui a seguito dell'operazione medesima. I successivi commi 49 - 52 consentono l'effettuazione mediante credito telefonico di una serie di erogazioni liberali destinate agli Enti del Terzo settore (oggi disciplinati dal D.Lgs. n. 117/2017), definendone, con un apposito decreto interministeriale, le caratteristiche ed il trattamento fiscale. Gli importi destinati ai beneficiari costituiscono erogazione liberale e pertanto sono esclusi dall'ambito di applicazione dell'imposta sul valore aggiunto e non sono deducibili ne' detraibili ai fini delle imposte sui redditi.   • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
