SENTENZE DI CONDANNA A FAVORE DEL CONTRIBUENTE - PUBBLICATI I MODELLI PER PRESTARE LA GARANZIA


È stato pubblicato, sulla Gazzetta Ufficiale n. 142 del 21 giugno 2017, il decreto del Ministero dell'Economia e delle Finanze 18 maggio 2017, recante "Modelli da utilizzare per prestare la garanzia per l'esecuzione delle sentenze di condanna a favore del contribuente". Con questo decreto, che completa il quadro normativo relativo all'attuazione delle modifiche del processo tributario introdotte dal D.Lgs. n. 156/2015, il Ministero dell'Economia e delle Finanze ha approvato i modelli da utilizzare per prestare la garanzia per l'esecuzione delle sentenze di condanna a favore del contribuente. Il provvedimento dà attuazione a quanto previsto dal D.M. del 6 febbraio 2017, n. 22 secondo cui la garanzia per l'esecuzione delle sentenze deve essere redatta in conformità ai modelli approvati con decreto del Direttore generale delle Finanze. L'art. 69 del D.Lgs. n. 546/1992 prevede che le sentenze di condanna al pagamento di somme in favore del contribuente sono immediatamente esecutive ed il pagamento di somme dell'importo superiore a 10.000 euro, diverse dalle spese di lite, può essere subordinato dal giudice, anche tenuto conto delle condizioni di solvibilità dell'istante, alla prestazione di idonea garanzia. I modelli approvati sono i seguenti: modello di polizza fideiussoria o fideiussione bancaria; modello per l'assunzione di obbligazione di pagamento da parte della capogruppo o controllante; modello per la costituzione di deposito vincolato in titoli di Stato o garantiti dallo Stato.   • it will be held on behalf of the Controller by KUMBE, the Controller’s maintainer for digital services, on the cloud server and related backup, in turn managed in compliance with the GDPR for the entire term of the contract with the Controller – who may dispose of it at any time – and until its subsequent cancellation.
  • it will not be assigned to third parties; it will not be used for marketing campaigns except if concurrently authorized for such purposes.
  • the user will have a profile created based pon the information contained therein and the data may be used for statistical processing.
