Tempo e luogo di consumazione del reato.La Cassazione ha affermato che il luogo di consumazione nelle truffe on line è quello ove viene effettuata la ricarica ad opera della persona offesa. Bisogna infatti attribuire rilievo - si legge nella sentenza - alla circostanza che tale modalità di pagamento si sostanzia nella creazione di una provvista che il beneficiario potrà utilizzare a suo piacimento mediante uno strumento di pagamento (solitamente una carta di credito di tipo ricaricabile tipo postepay) e sulla circostanza, del tutto peculiare di tale forma di pagamento, consistente nel fatto che, nel caso di pagamento effettuato tramite ricarica, la spoliazione della persona offesa è immediata ed irrevocabile e l'accredito della provvista in favore del soggetto agente è pressoché contestuale alla deminutio patrimonii del soggetto passivo. In ogni caso - afferma la Cassazione - trattandosi di pagamento non revocabile, a prescindere dalla data di accredito dell'importo sul conto del beneficiario, il reato si consuma con l'ormai definitiva lesione patrimoniale del raggirato. Dunque, il principio di diritto che è stato affermato: "nel delitto di truffa, quando il profitto è conseguito mediante accredito su carta di pagamento ricaricabile (nella specie "Postepay"), il tempo e il luogo di consumazione del reato sono quelli in cui la persona offesa ha proceduto al versamento del denaro sulla carta, poiché tale operazione ha realizzato contestualmente sia l'effettivo conseguimento del profitto da parte dell'agente, che ottiene l'immediata disponibilità della somma versata, e non un mero diritto di credito, sia la definitiva diminuzione patrimoniale in danno della vittima". Pertanto la competenza territoriale, si radica, ai sensi dell'art. 8 c.p.p. nel luogo di consumazione, per tale si intende il luogo in cui la persona offesa ha effettuato il versamento del denaro sulla carta di pagamento ricaricabile. Cass. Penale, Sez. II, 24 gennaio 2018 n. 3329.
